Funniest part: there was a window of time they could’ve agreed to give football and basketball players like $100,000 a year and non-rev sports some nominal salary and everybody would’ve happily signed on for that. The NCAA avoided solutions, fought for status quo, got fleeced.

Notable news in the c/o '22 class action. We definitely won't have a decision before Oct. 13. I won't hazard a guess as to how the 10th Circuit will rule. But one of- perhaps the most- significant issues is whether the athletes offered enough evidence of the relevant market as required to support an antitrust claim. Four federal appeals circuits have thrown out athlete injunctions on those grounds (most recently the 9th). The one issue I'm comfortable making a prediction on: the 10th will likely find that the NCAA's eligibility rules are "commercial in nature" and subject to antitrust scrutiny. The NCAA has argued that its eligibility rules are not commercial, but every other federal appellate court to consider that issue has ruled against them.

Wisne update: the 10th Circuit Court of Appeals has set a special session hearing date of October 13th for oral arguments on the NCAA's appeal. Unlikely that the Court rules from the bench, but this is at least a step toward a ruling on this pivotal class action litigation.

In the "old days", the NCAA rule was that if you played a player later deemed ineligible, then you forfeited all the games that player played in. So many players got screwed by this rule even if ultimately deemed eligible. See former UNC football player Devon Ramsay's case.

One judge in Monroe County, Indiana has ordered that the NCAA "and its members" may not enforce eligibility rules against 97 athletes until a trial she has not scheduled. The NCAA's members are roughly 1,100 institutions in all 50 states. UNC and NC State are among them.

This is a BIG one. Not just for the quality of the players, or the quantity, but the fact that it happened in the NCAA's own backyard. Indiana courts, as you might expect, have historically been very deferential to the NCAA. The inevitable appeal will be interesting.

Indiana football players Stephen Daley and Kellan Wyatt and been granted a preliminary injunction. They are now allowed to play for the Hoosiers Also, a number of athletes who joined this lawsuit have been granted the ability to play by a Monroe County court.

If other courts continue to make these same findings, I don’t know how the NCAA can in good faith continue to fight the 5 in 5 cases. When courts find your own rulebook says the class of 2022 athletes are eligible you have a major problem.
