Just so everyone is crystal clear. A 90% AMI reset rent in a gut renovated rent stabilized apartment would be $5000 per month cheaper than this. Only $383 more then the rent from 2021… 5 years later… it would also be frozen for two years.. and it would be rent stabilized… and mandated and inspected to 2026 and beyond code standards… and at no cost to current renters or tax payers… There are upwards of 60,000 currently vacant one and multiple bedroom apartments this could be done too. But reasons.

A great seller’s broker creates a strategy based on market feedback, not a predetermined script. One of the biggest mistakes a broker can make is deciding the entire process before the market has had an opportunity to speak. Four weeks of marketing. Bid deadline. Second round. Best-and-final. Contract. Closing. It looks organized. But after more than four decades selling investment properties in NYC, I believe it misunderstands how a competitive process works. A seller’s broker needs a strategy. But the strategy should never become a script. Even the timing of the first bid deadline requires judgment. Set it too early and it can backfire. If buyers haven't had enough time to underwrite the property and sufficient competition hasn't developed, you may have weak participation. Then you are chasing the market instead of having the market chase you. A bid deadline should be called when you have earned the right to call one. And once the bids arrive, let the market tell you what to do next. Suppose guidance is in the low-to-mid $40 millions and we receive 20 offers above $40 million. Fantastic. We may run a second round, third round, final round, “final-final” round or even send contracts to multiple bidders. We keep going until someone separates themselves from the pack. But suppose one buyer bids $50 million while everyone else is at $44-$45 million, and the $50 million buyer has a strong deposit, limited contingencies and can close quickly. Why automatically run three more rounds? Doing so might jeopardize the best deal. Another critical element: buyers must trust the process. No buyer wants competition. Almost every buyer would rather have the broker come directly to them and make a deal. But we represent sellers. Our job is to create as much legitimate competition as possible. Here is the paradox: We can only create competition if buyers are willing to participate. If buyers believe someone else is getting preferential treatment or they don't have a legitimate opportunity to win, they stop participating. That is why a level playing field is so important. Fairness isn't inconsistent with aggressive seller representation. It is essential to it. When buyers trust the process, they stay engaged. They sharpen their pencils. They improve their terms. They compete. And competition creates leverage for the seller. Sometimes the right move is another round. Sometimes it is narrowing the field. Sometimes it is negotiating with two buyers. Sometimes it is sending out multiple contracts. And sometimes it is grabbing the bird in the hand and getting the contract signed. The broker's job isn't simply to run a process. It is to diagnose the competitive environment and determine what move creates the greatest advantage for the seller. Have a strategy. Never become married to the script. The best process is not the one you can predict before you begin. It is the one you intelligently design as the market reveals itself.
